Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Earn4 website, application, public recruiting profiles, Highlight Builder, and related services (together, the "Service"). These Terms form a legally binding agreement between you and Earn4 LLC ("Earn4," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

Your electronic acceptance of these Terms during signup and, where applicable, at the time you start a subscription, forms part of this agreement.

2. Description of the Service

Earn4 is a self-guided college baseball recruiting software platform for Pre-HS athletes age 13 and older, high school athletes, junior college athletes, and their families. Depending on the tools you use, the Service may include a grade-based recruiting roadmap, Academy, Resource Library, School Tracker, Recruiting Calendar, reminders and follow-ups, a Public Recruiting Profile, Highlight Builder, a recruiting-readiness quiz, and related account, billing, and support features.

Earn4 is software. Earn4 is not a recruiting agency or representation firm, does not contact coaches on behalf of users, and does not negotiate offers. Earn4 does not guarantee offers, scholarships, roster spots, admission, eligibility, or any recruiting outcome. The Service is not designed specifically for transfer-portal recruiting.

3. Eligibility

You must be at least 13 years old to use Earn4. Users ages 13–17 should use Earn4 with the involvement and permission of a parent or legal guardian.

During signup you confirm that you are at least 13 years old. Earn4 does not operate a verified parental-consent workflow and does not permit accounts for children under 13.

4. Accounts and Membership Use

Each Earn4 membership is intended for one athlete. Family members may assist the athlete through the athlete's account. Earn4 does not currently provide separate parent accounts.

You agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs under your account. Accounts may not be sold, transferred, or resold. Please report suspected unauthorized access promptly to support@earn4.app.

5. Subscriptions and Automatic Renewal

Earn4 offers monthly and annual billing at the prices shown on the Pricing page. Current advertised pricing is $79 per month or $790 per year; the price shown at checkout is the final price for your subscription. Applicable taxes may be added at checkout.

Subscriptions are billed in advance at the cadence you select and renew automatically until cancelled. You can view and manage your billing at any time through Settings → Manage Subscription.

6. Cancellation, Past-Due Accounts, and Reactivation

You may cancel your subscription at any time from Settings → Manage Subscription. Cancellation takes effect at the end of your current paid billing period, and full membership access continues through that date.

After the paid period ends, your account moves to a read-only state. You may still sign in and view the information already in your account, but membership features become read-only until you reactivate. Reactivating restores full access to your preserved data.

If a renewal payment fails, your account may be moved to a read-only state while Stripe attempts to recover the payment according to the billing settings in effect at that time. If recovery is unsuccessful, your subscription may be cancelled. Your data is preserved during read-only status and cancellation unless you separately request deletion.

7. Refunds

Refunds are governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference.

8. Price Changes

We may change subscription prices from time to time. If a change affects an existing subscription, the new price will apply at a future renewal after notice is provided, and you may cancel before the new price takes effect. Additional notice will be provided where required by law.

9. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any law.
  • Provide false age, identity, athletic, academic, or recruiting information, or impersonate another person.
  • Sell, transfer, or share your account without authorization.
  • Upload material you do not have the right to submit, or infringe copyrights, trademarks, or other rights.
  • Harass, threaten, abuse, or defame others; spam coaches, schools, players, or other users; or publish another person's private information without permission.
  • Upload malicious files or code, or attempt unauthorized access to any system.
  • Scrape or extract data by automated means.
  • Bypass billing, export, access, or usage limits.
  • Reverse engineer the Service where legally restrictable.
  • Disrupt or overload the Service.
  • Abuse the contact, quiz, email, AI, video, or export systems.
  • Misrepresent affiliation with Earn4 or with any college program, coach, or school.
  • Resell or commercially exploit the Service without our written permission.

10. Earn4 Intellectual Property

Earn4 LLC owns or licenses the Service and its components, including the software, brand, logos, original written content, Academy materials, Resource Library materials, templates, designs, original graphics, quiz content, and Highlight Builder end-card designs. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable right to use the Service for your own recruiting.

School names, logos, marks, and other institutional intellectual property remain the property of their respective owners. Their inclusion in the Service is for identification, information, and educational purposes only, and does not imply endorsement, sponsorship, affiliation, or partnership with Earn4.

11. User Content

You retain ownership of the content you submit to Earn4. You grant Earn4 the license reasonably necessary to host, store, process, secure, display when directed by you, publish when you choose to publish (for example, when you enable a public profile), generate thumbnails, process AI-assisted features on your content, render highlight videos, and otherwise operate the Service on your behalf.

You represent that you have the rights to all clips, photos, documents, links, logos, and other material you submit. Private School Tracker notes remain private to your account unless you independently share them.

12. Public Recruiting Profiles

Public profiles are off by default. You control whether to publish, what to include, and when to unpublish. Once you publish, the information on your public profile can be viewed without signing in and may be copied, shared, or indexed by third parties. Disabling your profile does not remove copies that have already been made. Please do not publish information you do not want to be public.

13. Highlight Builder and AI Features

Video uploads, encoding, storage, and playback are handled by Mux. Final renders are produced by Shotstack. Limited still-frame thumbnails from your uploads may be processed through the Lovable AI Gateway and Google Gemini to support AI-assisted features such as trim suggestions and mismatch flags. Raw video is not sent to the AI provider under the current implementation.

AI-assisted suggestions may be inaccurate. You are responsible for reviewing every clip and every final export. Earn4 does not guarantee that an AI suggestion identifies the correct action.

Intermediate assets are cleaned up on the product's retention schedule. Highlight Builder is not permanent video hosting; please download completed exports and store them on a permanent platform. Each membership currently includes up to five completed exports per month. Unused exports do not roll over. Failed renders do not count against your monthly limit. Reasonable technical limits may change with notice.

14. Recruiting Information and Disclaimers

Recruiting calendars, rules, contact periods, eligibility rules, school information, rosters, coaches, and staff can change. NCAA, NAIA, NJCAA, admissions, and institutional requirements can change. You should verify important information directly with the relevant official organizations and institutions.

Earn4 does not provide eligibility decisions and does not provide legal, tax, financial, medical, or admissions advice. Earn4 is not responsible for coach decisions, school decisions, roster needs, or recruiting outcomes.

15. Third-Party Services and Links

Earn4 relies on third-party providers to deliver the Service, including Supabase, Stripe, Cloudflare, Lovable Emails, Mux, Shotstack, the Lovable AI Gateway and Google Gemini, PostHog, Sentry, Google OAuth, and BetterStack. These providers may have their own terms and policies that apply to their portion of the Service.

External school, coach, YouTube, social media, and resource links may change, move, or become unavailable, and Earn4 is not responsible for third-party websites or services outside its control.

16. Service Availability and Changes

We may maintain or update the Service, add, change, or remove features, modify reasonable technical limits, replace service providers, and temporarily suspend features for security or maintenance. We do not promise uninterrupted availability.

If Earn4 permanently discontinues the paid Service, treatment of unused paid time will follow the Refund & Cancellation Policy and applicable law.

17. Suspension and Termination

We may suspend or terminate access to the Service for material Terms violations, illegal or abusive conduct, fraud, chargebacks, nonpayment, security threats, misuse of the Service, legal requirements, or discontinuation of the Service. Termination of access is distinct from subscription cancellation. Termination does not necessarily result in immediate deletion of your data; retention follows our Privacy Policy.

18. Warranty Disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Earn4 does not guarantee that the Service will always be available, uninterrupted, error-free, secure, or accurate. This includes third-party services, AI suggestions, video processing, recruiting information, external links, and school and coach information. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

19. Limitation of Liability

To the maximum extent permitted by law, Earn4 LLC and its officers, employees, contractors, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Service.

Subject to rights that cannot be waived under applicable law, the total liability of Earn4 LLC and the parties listed above for any claim arising out of or related to these Terms or the Service will not exceed the greater of the amount you paid to Earn4 during the 12 months before the claim and $100.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be limited under applicable law.

20. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Earn4 LLC and its officers, employees, contractors, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your user-submitted content, your illegal use of the Service, your intentional or material violation of these Terms, your infringement of third-party rights, or your misrepresentation.

21. Feedback

You are not required to submit feedback. If you voluntarily provide suggestions, ideas, or feedback about Earn4, you grant Earn4 LLC a nonexclusive, worldwide, royalty-free license to use that feedback to operate, develop, and improve the Service. This does not transfer ownership of your other user content to Earn4.

22. Electronic Communications

By using Earn4 you consent to receive electronic communications from us relating to your account, security, billing, subscriptions, support, quiz results, membership status, parent digest emails (where enabled), and legal notices. These communications may be sent by email or delivered through the Service.

23. Governing Law and Venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where applicable law requires otherwise. Subject to rights that cannot be waived under applicable law, disputes may be brought in the state courts of Idaho or the United States District Court for the District of Idaho.

24. Changes to the Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and provide additional notice when required by law or when changes are material. Your continued use of the Service after the effective date of updated Terms constitutes acceptance where permitted by law.

25. Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms, together with our Privacy Policy, our Refund & Cancellation Policy, and any additional terms we present to you at the time of purchase, form the entire agreement between you and Earn4 LLC relating to the Service. Nothing in these documents purports to override rights that cannot legally be waived.
