Terms of Service

1. Acceptance of these Terms

These Terms of Service ("Terms") govern your access to and use of the Earn4 website, application, athlete and family accounts, published recruiting profiles, Highlight Builder, School Tracker, Recruiting Inbox and connected-Gmail recruiting email features, Academy and Resource Library, Recruiting Calendar, Parent Digest, recruiting-readiness quiz, college coach accounts, and related account, billing, and support features (together, the "Service"). These Terms form a legally binding agreement between you and Earn4 LLC ("Earn4," "we," "us," or "our"). If you do not agree to these Terms, do not use the Service.

Your electronic acceptance of these Terms during signup, during a parent or guardian authorization step where applicable, and at the time you start a membership forms part of this agreement. These Terms work together with our Privacy Policy, our Refund & Cancellation Policy, and, for college coach accounts, the Coach Terms & Acceptable Use.

2. What Earn4 is

Earn4 is recruiting software for baseball families. It provides an Academy curriculum, a Resource Library, a School Tracker with follow-up tracking, a Recruiting Calendar, optional recruiting email tools that work with a Gmail account you connect, a recruiting profile you may choose to publish, Highlight Builder video tools, an optional Parent Digest email summary for families, a recruiting-readiness quiz, and related account, billing, and support features.

Earn4 is software. Earn4 is not a recruiting agency or representation firm, does not contact coaches on your behalf, and does not negotiate offers. Earn4 does not guarantee offers, scholarships, roster spots, admission, eligibility, or any recruiting outcome. The Service is not designed specifically for transfer-portal recruiting.

3. Account types

Earn4 offers two distinct account types.

Athlete and family accounts

Athlete and family accounts are paid memberships. Each membership is intended for one athlete. Family members may assist the athlete through the athlete's account. Earn4 does not currently provide separate parent logins.

College coach accounts

College coach accounts are a separate, free account type. They are not memberships, are not subscriptions, and do not include athlete or family features. Coach accounts are governed by the Coach Terms & Acceptable Use, which control where they differ from these Terms.

Membership, billing, refund, and parent authorization provisions of these Terms apply only to athlete and family accounts. Coach-specific obligations do not apply to athlete accounts.

4. Eligibility and age

You must be at least 13 years old to use Earn4. Earn4 does not permit accounts for children under 13, and we do not knowingly collect information from them. During signup you confirm that you meet the minimum age requirement.

You may create an account using an email address and password or, where available, through third-party authentication providers, such as Google, where available.

5. Athletes ages 13–17 and parent or guardian involvement

Athletes ages 13–17 are expected to use Earn4 with the involvement and permission of a parent or legal guardian. Depending on the athlete's age and how the account was created, Earn4 requires a parent or guardian authorization step before certain parts of the Service can be used.

Where a parent or legal guardian creates the account or completes the required authorization process, that parent or guardian agrees to these Terms and is bound by them in connection with the minor athlete's account. In doing so, the parent or guardian:

  • authorizes the athlete's use of Earn4;
  • agrees to these Terms where the authorization flow requires it;
  • is responsible for appropriate oversight of the minor's account and activity;
  • may exercise applicable account and privacy choices on behalf of the minor where the Service supports it, including profile publication and protected contact permissions.

The under-13 prohibition applies regardless of parent or guardian involvement.

6. Your account and security

You agree to provide accurate information and to keep your credentials secure. You are responsible for all activity that occurs under your account. Accounts may not be sold, transferred, or resold, and credentials may not be shared with or used by another person. Please report suspected unauthorized access promptly to support@earn4.app.

7. Membership, pricing, and automatic renewal

This section applies to athlete and family memberships. Coach accounts are free and are not billed.

Earn4 offers monthly and annual billing at the prices shown on the Pricing page. Current advertised pricing is $79 per month or $790 per year; the price shown at checkout is the final price for your membership. Applicable taxes may be added at checkout.

Memberships are billed in advance at the cadence you select and renew automatically until cancelled. You can view and manage billing at any time through Settings → Manage Subscription.

8. Cancellation, past-due accounts, and reactivation

You may cancel at any time from Settings → Manage Subscription. Cancellation takes effect at the end of your current paid billing period, and full membership access continues through that date.

After the paid period ends, your account moves to a read-only state. You may still sign in and view the information already in your account, but membership features become read-only until you reactivate.

If a renewal payment fails, your account may be moved to a read-only state while our payment processor attempts to recover the payment under the billing settings in effect at that time. If recovery is unsuccessful, your membership may be cancelled.

Your account data is preserved during read-only status and after cancellation, subject to our Privacy Policy and retention practices, unless you separately request deletion. Reactivating restores access to your preserved account data where that data remains available.

9. Refunds

Refund eligibility and requests are governed by the Refund & Cancellation Policy, which is incorporated into these Terms by reference.

Cancelling a membership stops future renewals; it does not by itself create a prorated refund for the unused portion of a billing period, except as required by applicable law or as expressly provided in the Refund & Cancellation Policy.

10. Price changes

We may change membership prices from time to time. If a change affects an existing membership, the new price will apply at a future renewal after notice is provided, and you may cancel before the new price takes effect. Additional notice will be provided where required by law.

11. Recruiting profiles and profile visibility

Every recruiting profile begins Private. Nothing is published until you choose to publish it.

  • At launch, publishing a profile makes it Unlisted. Anyone with the link can view the recruiting information you have intentionally published.
  • Unlisted does not mean confidential. Published information can be copied, shared, or forwarded by anyone who has the link, and unpublishing does not remove copies that have already been made.
  • Earn4 does not provide athlete search or discovery at launch. There is no public directory, and coaches cannot browse or search for athletes on Earn4.
  • A future discoverable profile option is not live and is not part of the current Service.

You control what to include on your published recruiting profile and when to unpublish it. Please do not publish information you do not want others to see. Academic transcripts and documents you upload remain private and are not published on your recruiting profile.

12. Protected contact information

Certain contact information is treated as protected and is never displayed on a published recruiting profile: athlete email and phone, parent or guardian email and phone, and reference email and phone.

  • Families independently choose which applicable contact methods verified college coaches may access. Each contact method defaults off.
  • Reference contact sharing is controlled separately for each reference.
  • Access is available only to an eligible Earn4-verified college coach in good standing.
  • Permission may be withdrawn at any time going forward. Withdrawal cannot recall information that has already been viewed.
  • No coach is entitled to protected contact information merely because they have an account, are verified, or have saved an athlete.
  • Protected contact information may be used only for legitimate college recruiting purposes.

13. References

If you add a reference — such as a coach, trainer, teacher, or mentor — you are responsible for having appropriate permission to provide that person's identity and contact information to Earn4 and to authorize its sharing with verified college coaches.

  • A reference's name, role, and organization may be displayed on your published recruiting profile where you include them.
  • Reference phone numbers and email addresses are never public.
  • Family-controlled protected sharing applies separately to each reference, and defaults off.

If a reference asks to be removed, please remove them promptly or contact support@earn4.app.

14. Coach verification and coach features

Earn4 determines coach verification status in its discretion. Verification may be approved, denied, suspended, or revoked. Verification is a good-faith review process, not a guarantee of identity, and it does not constitute an endorsement of any coach, program, or institution.

Verification does not entitle a coach to protected contact information. Protected access always remains subject to the family's permissions and the coach's continuing eligibility and good standing.

Saved Athletes

Saved Athletes is a private bookmarking and organization feature for coaches. Saving an athlete does not grant protected contact access, does not change the athlete's sharing settings, and does not create any recruiting relationship, offer, commitment, or entitlement of any kind.

Coach activity

Certain signed-in coach activity and protected-access events may be recorded to provide Service functionality, to give families visibility into recruiting activity, and to support security, abuse prevention, and enforcement.

15. Acceptable use and prohibited conduct

You agree not to do any of the following. College coach accounts are additionally subject to the Coach Terms & Acceptable Use, which apply in addition to this section.

  • Use the Service for any unlawful purpose or in violation of any law.
  • Provide false age, identity, athletic, academic, or recruiting information, or impersonate another person.
  • Impersonate a college coach or misrepresent your affiliation with any college program, institution, or with Earn4.
  • Falsify or misrepresent verification evidence.
  • Share credentials, or allow another person to use your account or a verified coach session.
  • Circumvent or attempt to circumvent verification, access, or security controls.
  • Scrape, crawl, or extract data by automated means or in bulk.
  • Build an external athlete, family, or contact database from Earn4 information.
  • Bulk download or systematically collect athlete information.
  • Sell, license, redistribute, publish, or commercially exploit protected athlete, family, or reference contact information.
  • Use protected contact information for any purpose unrelated to legitimate college recruiting.
  • Harass, threaten, abuse, or defame others; send spam; or make inappropriate contact with an athlete, family member, or reference.
  • Access or attempt to access information outside the permissions athletes and families have provided.
  • Publish another person's private information without permission, or upload material you do not have the right to submit.
  • Upload malicious files or code, or attempt unauthorized access to any system.
  • Interfere with, disrupt, overload, or degrade the security or operation of Earn4.
  • Bypass billing, export, access, or usage limits.
  • Reverse engineer the Service where legally restrictable.
  • Abuse the contact, quiz, email, AI, video, or export systems.
  • Resell or commercially exploit the Service without our written permission.
  • Use the connected-Gmail recruiting email features to send spam, bulk, unsolicited commercial, chain, or automated mass email, or to send messages to recipients who have asked not to be contacted.
  • Send misleading, deceptive, harassing, threatening, or impersonating messages through a connected account, or misrepresent who you are or which athlete you represent.
  • Use the connected-Gmail features for anything other than 1:1 college recruiting communication for the athlete on the account.
  • Connect a Gmail account you are not authorized to use, or use another person's connected account.
  • Circumvent, or attempt to circumvent, the sending limits, disclosure steps, or parent or guardian acknowledgment requirements that apply to these features.

16. Earn4 intellectual property

Earn4 LLC owns or licenses the Service and its components, including the software, brand, logos, original written content, Academy materials, Resource Library materials, templates, designs, original graphics, quiz content, and Highlight Builder end-card designs. Subject to these Terms, we grant you a limited, personal, nonexclusive, nontransferable right to use the Service for your own recruiting.

School names, logos, marks, and other institutional intellectual property remain the property of their respective owners. Their inclusion in the Service is for identification, information, and educational purposes only, and does not imply endorsement, sponsorship, affiliation, or partnership with Earn4.

17. Your content

You retain ownership of the content you submit to Earn4 ("User Content"). You grant Earn4 only the rights reasonably necessary to host, store, process, secure, encode, transmit, display when directed by you, publish when you choose to publish, create thumbnails, use still frames for supported AI processing, render highlight videos, and otherwise provide and operate the Service on your behalf.

You represent that you have the rights and permissions needed for all clips, photos, documents, links, logos, and other material you submit, including permission from anyone else who appears in your video. Private School Tracker notes and uploaded transcripts remain private to your account unless you independently share them.

You may not upload, publish, or share content you do not have the rights to use, including video, photographs, music, graphics, or other copyrighted material.

If you believe content available through Earn4 infringes a copyright you own or are authorized to enforce, you may send a written notice to Earn4's designated DMCA agent:

To help us evaluate the request, the notice should include: identification of the copyrighted work claimed to have been infringed; identification of the material claimed to be infringing and information reasonably sufficient for us to locate it; your name and contact information; a statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; a statement that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner; and your physical or electronic signature. Full details, including counter-notification information, are in our DMCA Copyright Policy.

Earn4 may investigate copyright complaints and may remove or disable access to content where appropriate. We may restrict or terminate accounts of users who repeatedly infringe the intellectual-property rights of others.

If content you submitted is removed or restricted because of a copyright complaint and you believe the removal was made in error, you may submit a counter-notification as described in our DMCA Copyright Policy.

19. Highlight Builder and AI features

Video uploads, encoding, storage, and playback are handled by our video provider, and final renders are produced by our rendering provider. Limited still frames from your uploads may be processed by an AI provider to support AI-assisted features such as trim suggestions and mismatch flags. Raw video is not sent to the AI provider under the current implementation.

AI-assisted suggestions may be inaccurate. You are responsible for reviewing every clip and every final export before you share it.

Each membership currently includes up to five completed exports per calendar month. Unused exports do not roll over, and failed renders do not count against the limit. Reasonable technical limits may change with notice.

Intermediate assets are cleaned up on the product's retention schedule. Highlight Builder is not permanent video hosting; please download completed exports and store them on a platform you control.

19A. Connected Gmail and recruiting email

Optional feature. You may connect a Gmail account so Earn4 can send recruiting emails and replies from your own address. This is optional and you may disconnect at any time.

Your authorization to send. By connecting a Gmail account and using these features, you authorize Earn4 to send the messages you compose and submit in Earn4 from that account on your instruction. Earn4 does not send messages from your account that you did not submit.

Your responsibility for content and recipients. You are solely responsible for the content of every message you send, for who you send it to, for the accuracy of what you claim in it, and for complying with applicable law and with any recruiting rules or contact-period restrictions that apply to you. Earn4 does not review or approve your messages before they are sent.

Reading and syncing is separate. Recruiting email syncing, which lets Earn4 read the connected account in order to recognize recruiting activity, is a separate permission you grant explicitly and can revoke. It is described in the Recruiting Email Sync Disclosure and in our Privacy Policy. For athletes under 18, a parent or guardian must acknowledge that disclosure before syncing can be enabled.

Dependency on Google. These features depend on Gmail and other Google services, which are provided by Google under Google's own terms and policies and are outside Earn4's control. Google may change, limit, suspend, or revoke access to those services or to your account at any time. Earn4 is not responsible for Google's actions, availability, or decisions, and these features may become unavailable as a result.

Limits. Earn4 applies reasonable technical and anti-abuse limits to sending through a connected account, which may change with notice, and may pause sending where abuse or a security risk is suspected. Google separately applies its own sending and API limits to your account, which Earn4 does not control and cannot raise. Reaching a Google limit is not an Earn4 failure.

No guarantees. Earn4 does not guarantee that any message will be delivered, will avoid a spam or promotions folder, will be opened, read, or replied to, or will produce any coach interest, evaluation, exposure, offer, scholarship, roster spot, admission, or other recruiting outcome. Earn4 does not guarantee that every recruiting message in a connected account will be recognized, matched to the correct school, or surfaced in the Service, or that non-recruiting email will always be excluded.

Suspension and disconnection. Earn4 may disconnect a connected account, disable syncing, or suspend these features, with or without prior notice where necessary, if we reasonably believe they are being misused, if abuse or spam is reported, if a security risk arises, if Google requires it, or if required by law. Disconnection does not by itself delete the recruiting history already in your account; see our Privacy Policy.

20. Recruiting-readiness quiz

The recruiting-readiness quiz is an informational self-assessment. Quiz scores and results do not represent a recruiting evaluation, coach interest, admission likelihood, athletic eligibility, scholarship likelihood, or roster likelihood, and should not be relied on for any recruiting decision.

21. Recruiting information and disclaimers

Recruiting calendars, rules, contact periods, eligibility rules, school information, rosters, coaches, and staff can change. NCAA, NAIA, NJCAA, admissions, and institutional requirements can change. You should verify important information directly with the relevant official organizations and institutions.

Earn4 does not provide eligibility decisions and does not provide legal, tax, financial, medical, or admissions advice. Earn4 is not responsible for coach decisions, school decisions, roster needs, or recruiting outcomes.

22. Third-party services and links

Earn4 relies on third-party providers to deliver the Service, including hosting, database and authentication, payment processing (currently Stripe), email delivery, video encoding and rendering, AI processing, analytics, error monitoring, and uptime monitoring providers, and Google, for the Gmail features you choose to connect and authorize. Those Gmail features are subject to Google's terms and policies in addition to these Terms. These providers may have their own terms and policies that apply to their portion of the Service, and we may change providers within these categories. Our Privacy Policy describes the categories of providers we use.

External school, coach, video, social media, and resource links may change, move, or become unavailable, and Earn4 is not responsible for third-party websites or services outside its control.

23. Service availability and changes

We may maintain or update the Service, add, change, or remove features, modify reasonable technical limits, replace service providers, and temporarily suspend features for security or maintenance. We do not promise uninterrupted availability.

If Earn4 permanently discontinues the paid Service, treatment of unused paid time will follow the Refund & Cancellation Policy and applicable law.

24. Restriction, suspension, and termination

We may restrict, suspend, or terminate access to the Service, in whole or in part, where reasonably appropriate, including for:

  • violation of these Terms, the Coach Terms & Acceptable Use, our acceptable use requirements, or other applicable policies;
  • fraud, abuse, harassment, chargeback abuse, or other misuse of the Service;
  • false identity or misrepresented affiliation;
  • attempted circumvention of coach verification or security controls;
  • misuse of athlete, family, or reference information;
  • scraping, bulk collection, resale, redistribution, or creation of an unauthorized database;
  • security risks to Earn4, its users, or its providers;
  • nonpayment, where applicable;
  • legal or regulatory requirements;
  • conduct we reasonably determine threatens Earn4, our users, or the integrity of the Service;
  • discontinuation of the Service or a feature;
  • misuse of the connected-Gmail recruiting email features, including spam, bulk or unsolicited messaging, misleading or harassing messages, and circumvention of sending limits or required disclosure or parent-acknowledgment steps.

Where reasonable, we may provide notice and an opportunity to address the issue before acting. We may act immediately and without prior notice where necessary to address safety, fraud, security, legal, or abuse concerns.

Termination of access is distinct from membership cancellation and does not necessarily result in immediate deletion of your data; retention follows our Privacy Policy. You may stop using the Service at any time.

25. Warranty disclaimer

To the maximum extent permitted by law, the Service is provided "as is" and "as available." Earn4 does not guarantee that the Service will always be available, uninterrupted, error-free, secure, or accurate. This includes third-party services, AI suggestions, video processing, recruiting information, external links, and school and coach information. Some jurisdictions do not allow certain warranty exclusions, so portions of this section may not apply to you.

26. Limitation of liability

To the maximum extent permitted by law, Earn4 LLC and its officers, employees, contractors, agents, and service providers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including lost profits, lost data, or business interruption, arising out of or related to your use of the Service.

Subject to rights that cannot be waived under applicable law, the total liability of Earn4 LLC and the parties listed above for any claim arising out of or related to these Terms or the Service will not exceed the greater of the amount you paid to Earn4 during the 12 months before the claim and $100.

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, or any other liability that cannot be limited under applicable law.

27. Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Earn4 LLC and its officers, employees, contractors, and agents from claims, damages, losses, and expenses (including reasonable legal fees) arising out of your User Content, your illegal use of the Service, your intentional or material violation of these Terms, your infringement of third-party rights, or your misrepresentation.

28. Informal dispute resolution

Before either you or Earn4 files a court action relating to these Terms or the Service, the party raising the dispute will send the other party written notice describing the dispute and the resolution requested. Notice to Earn4 may be sent to support@earn4.app or through the Contact page; notice to you may be sent to the email address on your account.

Both parties will then work in good faith to resolve the dispute informally for 30 days after that notice is received. This step does not prevent either party from seeking urgent injunctive or other equitable relief where necessary, and does not override any right that cannot legally be waived.

29. Governing law and venue

These Terms and any dispute arising out of or relating to them or the Service are governed by the laws of the State of Idaho, without regard to conflict-of-law principles, except where applicable law requires otherwise. Subject to rights that cannot be waived under applicable law, disputes may be brought in the state courts of Idaho or the United States District Court for the District of Idaho.

30. Feedback

You are not required to submit feedback. If you voluntarily provide suggestions, ideas, or feedback about Earn4, you grant Earn4 LLC a nonexclusive, worldwide, royalty-free license to use that feedback to operate, develop, and improve the Service. This does not transfer ownership of your other User Content to Earn4.

31. Electronic communications and notices

By using Earn4 you consent to receive electronic communications from us relating to your account, security, billing, membership status, support, quiz results, Parent Digest emails where enabled, and legal notices. These communications may be sent by email or delivered through the Service.

Legal notices to you will be sent to the email address on your account or posted in the Service. Legal notices to Earn4 must be sent to support@earn4.app, and are effective when received.

32. General terms

Assignment

You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, or to an affiliate, provided the recipient assumes our obligations.

Google user data carve-out. Data Earn4 obtained from Google Workspace or Gmail APIs is excluded from the general assignment and business-transfer right above. Where Google's policies require explicit prior consent from the user before such data may be transferred as part of a merger, acquisition, or sale of assets, Earn4 will not transfer that data unless that consent has been obtained; absent that consent, the data will be deleted rather than transferred.

Force majeure

Neither party is responsible for delays or failures caused by events beyond its reasonable control, such as natural disasters, outages of internet or third-party infrastructure, labor disruptions, or government action. This does not excuse payment obligations already incurred.

No waiver

If we do not enforce a provision of these Terms right away, we do not give up the right to enforce it later. A waiver is effective only if it is in writing.

Survival

Provisions that logically continue after termination survive, including those covering your content license, intellectual property, acceptable use restrictions relating to protected information and to the connected-Gmail recruiting email features, disclaimers, limitation of liability, indemnification, dispute resolution, governing law, notices, and these general terms.

Severability and entire agreement

If any provision of these Terms is found unenforceable or invalid, it will be limited or eliminated to the minimum extent necessary and the remaining provisions will remain in effect. These Terms, together with our Privacy Policy, our Refund & Cancellation Policy, the Coach Terms & Acceptable Use for coach accounts, and any additional terms presented at the time of purchase, form the entire agreement between you and Earn4 LLC relating to the Service. Nothing in these documents purports to override rights that cannot legally be waived.

33. Changes to these Terms

We may update these Terms from time to time. When we do, we will update the "Last updated" date and provide additional notice when required by law or when changes are material. Where appropriate or required, we may ask you to review and accept an updated version of these Terms before continuing to use some or all of the Service. Your continued use of the Service after an updated version becomes effective may constitute acceptance where permitted by applicable law.
